Lake Affairs Terms and Conditions

 

These terms and conditions are part of the adventure, training or sailing trip contract concluded with us. You confirm your consent to the inclusion of these conditions in the contract with your registration.

 

1. Conclusion of the contract

The offers on the Lake Affairs website are non-binding. With your booking, you offer Lake Affairs a binding conclusion of the contract on the basis of the service descriptions and price information. The contract is concluded upon acceptance by Lake Affairs. Acceptance, for which no special form is required, takes place by sending the booking confirmation and the invoice. Acceptance can also be declared by paying the deposit.

 

2. Payment

With the conclusion of the contract, usually with receipt of the booking confirmation, the total price is due immediately.

In the event that the agreed payments are not made in full even after the occurrence of default, Lake Affairs is entitled to withdraw from the contract and to claim damages in the amount of the corresponding withdrawal lump sums, unless you already had to withdraw at this point in time justifying lack of travel.

 

3. Sailing trip fees and ancillary costs

The booked packages include the fees and ancillary costs for port fees, permit, diesel, gas, skipper catering and final cleaning. Excessive soiling will be billed separately. The costs incurred during the sailing trip for e.g. drinks or other services that are not included in the booked package must be paid at the end of the sailing trip.

 

4. Instructions from the skipper

The participant acknowledges that in the case of practical courses and experiences on the ships, the decision of the skipper alone is decisive in every respect. The participant agrees to follow the instructions of the skipper in the nautical area and in matters of on-board operations.

 

5. Arrival and departure

The journey to and from the ship and any parking fees are not part of the service, unless this is expressly stated in the experience, training, charter or sailing trip description. If you would like additional services such as the organization of your journey or the transfer to the ship, please speak to Lake Affairs. The arrival should be on time. The skipper is not obliged to wait for late participants. The booked time slot is binding and must be adhered to because of subsequent bookings.

 

6. Resignation by Lake Affairs

Lake Affairs is entitled to withdraw from the experiences, tours, training courses, charter and sailing trip contracts if the implementation of the experiences, tours, training courses, charter or sailing trip contracts is impossible or endangered due to circumstances that were not known and could not be foreseen at the time the contract was concluded. Such circumstances are in particular events of force majeure, war, civil unrest, strikes, sovereign orders, epidemics, natural disasters, severe weather, unforeseeable inability to use the ship and the impossibility of replacement.

 

Lake Affairs is entitled to cancel the experiences, tours, training, charter and sailing trips up to 2 weeks before the start and to withdraw from them if the minimum number of participants specified in the experience, tour, training or sailing trip description has not been reached. In the event of cancellation by Lake Affairs, Lake Affairs will immediately reimburse you in full for the payments already made on the experience, training or sailing trip price. There are no further claims.

 

Our offers on the Mediterranean sea depend on the weather. If, due to the weather (storm, thunderstorm, waves, heavy rainfall) it is not possible to carry out a boat tour at the agreed time, we will work with you to find an alternative date or you will receive a refund.

 

7. Cancellation fees for sailing trips

If you withdraw from the experience, training, charter or sailing trip, a cancellation fee of 50% will be charged 4 weeks before the start and 80% 3 weeks before the start. The participant who cancels has the right to appoint a deputy. If this deputy is accepted by Lake Affairs, there are no cancellation fees. In the event of non-participation or non-appearance in the experience, training, charter or sailing trip without prior cancellation, the cancellation costs are 100%.

 

8. Validity of the vouchers

The voucher is valid for three years from purchase until the end of the year (December 31). The redemption of vouchers and participation in the experience must take place within the voucher validity.

 

9. Liability

The causer is responsible for any damage whose cause is known. Lake Affairs is not liable for property damage unless the damage was caused intentionally or through gross negligence, in particular not to personal equipment or luggage.

 

I have read the terms and conditions. I assure you that my health is in a position to take part in a sailing trip and I release Lake Affairs from any responsibility in this regard.
